Rubbish Clearance Elephant and Castle Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Clearance Elephant and Castle provides rubbish clearance and waste collection services. By making a booking, confirming a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business, organisation or other entity that requests or uses our waste collection or rubbish clearance services.

Services means any rubbish clearance, waste collection, loading, transportation, disposal, recycling, site tidy-up or related activity carried out by us.

Contract means the agreement between the Customer and Rubbish Clearance Elephant and Castle, formed in accordance with these Terms and Conditions.

Waste means any items, materials or substances presented to us for removal, collection or disposal.

We, us and our mean Rubbish Clearance Elephant and Castle.

2. Scope of Services

We provide rubbish clearance and waste collection services for domestic, commercial and other premises. This may include the removal of general household items, garden waste, office waste, light construction debris, bulky items and similar materials, subject to applicable regulations and any restrictions stated in these Terms and Conditions.

We reserve the right to refuse to remove any waste that we reasonably believe to be hazardous, prohibited, unlawful to carry, or unsafe for our operatives to handle or transport. Examples include, but are not limited to, asbestos, clinical or medical waste, certain chemicals, pressurised containers and other regulated substances.

3. Booking Process

3.1 Bookings may be made by telephone, email or other communication methods we make available. When making a booking, you must provide accurate information about the location, type and volume of waste, access conditions and any special requirements.

3.2 We may offer an estimated price based on the information you provide. This estimate is not a final quotation and may be revised on site once our operatives have assessed the waste and access.

3.3 A Contract is formed when you accept our quotation on site, confirm a booking in writing, pay a deposit where required, or permit our operatives to begin the clearance work.

3.4 You are responsible for ensuring that someone with authority to agree the work and charges is present at the property at the agreed time, unless we have agreed in advance to proceed in your absence.

4. Access and Site Conditions

4.1 You must ensure that our operatives have safe and reasonable access to the waste, including access to any communal areas, lifts, yards or external spaces as required. You must notify us in advance of any parking restrictions, loading limitations, gate codes or similar matters.

4.2 Any parking charges, permits, congestion charges, tolls or penalties that arise directly as a result of the service may be charged to you, unless caused by our fault.

4.3 If our operatives are unable to carry out the work due to access problems, inaccurate information provided by you, or unsafe conditions at the site, we may charge a call-out fee or a reasonable proportion of the quoted price to cover our time and costs.

5. Waste Description and Volume

5.1 Our pricing is generally based on the volume, weight and type of waste, as well as the labour involved and disposal costs. You agree to describe the waste as accurately as possible during the booking process.

5.2 On arrival, our operatives will assess the actual waste to be removed and confirm the final price before starting work. If the waste is significantly more than described, or includes materials that are heavier, more difficult to handle, or costlier to dispose of than anticipated, we may revise the quotation.

5.3 If you decide not to proceed after we have revised the price on site, we may charge a reasonable attendance fee to cover the costs of our visit.

6. Pricing and Quotations

6.1 Prices may be provided as estimates in advance or as quotations on site. Unless stated otherwise, all prices are exclusive of any applicable VAT or other taxes, which will be added at the prevailing rate where applicable.

6.2 Quotations are normally based on the information available at the time and remain valid for a limited period, which we will confirm to you. We reserve the right to withdraw or amend a quotation if circumstances change, including changes in disposal costs or regulatory requirements.

6.3 Any additional work requested during the visit that goes beyond the original scope, such as extra loads, additional labour, dismantling, or extended waiting time, may be subject to extra charges.

7. Payments

7.1 Payment is due in full on completion of the service, unless otherwise agreed in writing prior to the booking. We may accept payment by cash, card or other methods that we specify.

7.2 For business customers with agreed credit terms, invoices must be paid within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

7.3 If payment is not received by the due date, we reserve the right to charge interest on overdue amounts at the statutory rate and to recover any reasonable costs incurred in pursuing payment, including collection agency fees and legal costs.

7.4 We may suspend or cancel further services to you if any outstanding amounts remain unpaid.

8. Cancellations and Amendments

8.1 You may cancel or amend a booking by contacting us as soon as possible. Cancellations or significant changes made at short notice may incur charges, as set out below.

8.2 If you cancel the service more than 24 hours before the agreed arrival time, no cancellation fee will normally be charged, unless we have incurred specific costs that cannot be recovered.

8.3 If you cancel the service less than 24 hours before the agreed arrival time, or if our operatives attend but are unable to carry out the work due to your act or omission, we may charge a reasonable cancellation or call-out fee to cover our costs.

8.4 We reserve the right to cancel or reschedule a booking due to events outside our reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, accidents, or changes in legal or regulatory requirements. In such cases, we will seek to notify you as soon as practicable and offer a new appointment time or, where appropriate, a refund of any pre-paid amounts.

9. Customer Obligations

9.1 You must ensure that the waste presented for collection belongs to you or that you have full authority from the owner to arrange for its removal. By engaging our services, you warrant that you are entitled to dispose of the waste.

9.2 You must remove or clearly separate any items that you do not wish to be taken away. Our operatives may reasonably assume that items in the agreed collection area are to be removed, and we accept no liability for the removal of items that were not clearly identified as to be retained.

9.3 You must not knowingly present for collection any hazardous, illegal or prohibited waste. You agree to indemnify us against any losses, costs, fines or liabilities arising from your failure to comply with this obligation.

10. Our Responsibilities and Service Standards

10.1 We will carry out the Services with reasonable care and skill, using trained operatives and suitable vehicles for the job.

10.2 We will take reasonable steps to avoid damage to your property while performing the work. Where practicable, we will bring any risks to your attention before commencing work and may ask you to move fragile or high-value items.

10.3 On completion of the clearance, our operatives will make reasonable efforts to leave the area in a tidy condition, subject to the nature of the site and the work carried out.

11. Liability and Limitations

11.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable law.

11.2 Subject to the above, our total liability to you for any loss or damage arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total charges paid or payable by you for the specific service during which the event giving rise to the claim occurred.

11.3 We shall not be liable for any indirect or consequential loss, including but not limited to loss of profit, business interruption, loss of opportunity or reputational damage.

11.4 We are not liable for damage to items that were already defective, unstable or not fit to be moved, or for damage resulting from your failure to follow our reasonable advice regarding preparation or access.

11.5 You are responsible for checking that you have not left any personal belongings among the waste to be removed. We are not liable for any loss of items that you failed to separate or identify clearly as not to be taken.

12. Waste Handling and Environmental Compliance

12.1 We operate in accordance with applicable UK waste management legislation and regulations. All waste collected is transported to authorised facilities for disposal or recycling, in line with legal and environmental requirements.

12.2 We will only transfer waste to properly licensed or authorised facilities and carriers. Where applicable, waste transfer documentation will be completed in accordance with current regulations.

12.3 We aim to minimise the amount of waste sent to landfill by prioritising reuse and recycling where reasonably practicable, subject to available facilities and the nature of the materials collected.

12.4 Once the waste has been removed from your premises, title to the waste passes to us, and we will assume responsibility for its lawful handling and disposal, except where separate arrangements have been agreed.

13. Insurance

13.1 We maintain insurance cover appropriate to the nature of our business, including public liability insurance, in accordance with industry standards and legal requirements.

13.2 Details of our insurance cover can be made available on request. Our liability remains subject to the limitations set out in these Terms and Conditions.

14. Complaints and Disputes

14.1 If you have a concern or complaint about our Services, you should contact us as soon as possible, providing details of the issue and any supporting information.

14.2 We will investigate your complaint and aim to respond within a reasonable timescale. We may request further information or arrange a site visit where appropriate.

14.3 We will seek to resolve disputes amicably. If a dispute cannot be resolved informally, either party may pursue any legal remedies available under the governing law.

15. Data Protection and Privacy

15.1 We collect and process personal data only as necessary to provide our rubbish clearance and waste collection services, handle bookings, administer accounts and comply with legal obligations.

15.2 We will take reasonable steps to protect any personal information you provide to us and will not sell your data to third parties. We may share information with service providers, regulatory authorities or others where required by law or where necessary to deliver our services.

16. Changes to These Terms

16.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, pricing, legal requirements or other relevant factors.

16.2 The version of the Terms and Conditions that applies to your booking will be the version in force at the time your Contract is formed, unless we have expressly agreed otherwise in writing.

17. Severability

17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

18.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our rubbish clearance and waste collection services.

By placing a booking or allowing our operatives to proceed with the clearance, you confirm that you have read, understood and agree to these Terms and Conditions.
